Privacy requirements and foreign regulatory obligations

The Office of the Privacy Commissioner has written to the United States Securities and Exchange Commission (SEC) on request to provide a view as to the application of the Personal Information Protection Act (PIPA) in the context of Bermuda-based organisations with US regulatory obligations.


This letter provides general guidance to assure organisations that PIPA does not prevent the sharing of personal information to meet requirements under law or public interest, even potential foreign regulatory requirements, provided the organisation meets its other obligations under the act.
